Reclaiming Tiananmen 2014: Report PDF Print E-mail

[10 June 2014] To mark the 25th anniversary of the Tiananmen Square protests and massacre, Amnesty International UK, Friends of Tiananmen Mothers UK, and Chinese, Uighur & Tibetan Solidarity UK worked alongside activists to remember those who lost their lives, highlight the need for truth and justice and continue the campaign for human rights, freedom and democracy in China.

1. Tank Man in Trafalgar Square
Tank Man in Trafalgar SquareOn 31 May, the famous scene of an anonymous Chinese man stopping a convoy of tanks in Tiananmen Square in 1989 was re-enacted in Trafalgar Square by members of Chinese Uyghur Tibetan Solidarity UK.

The tanks, depicted on large boards, moved across Trafalgar Square before being intercepted by a solitary protestor. The boards were then flipped over to reveal messages including: "4 June 1989: Tiananmen Square, Beijing. Over 1,000 killed. Thousands imprisoned" "Truth for June 4th" and "Freedom, Human Rights, Democracy".

2. Exhibition: 64+25=89
Post-massacreA public exhibition of photos was held at Amnesty International UK, from 28 May - 5 June, depicting the Tiananmen Square protests and massacre. The images showed the beginnings of the student protests in Beijing in April 1989, how they grew over the subsequent weeks with students, workers and even party officials taking part, and concluded with tragic consequences as armed forces killed hundreds of protestors on 3 and 4 June.

The title "64+25=89" derives from 64 representing June 4th, 25 for the anniversary and 89 for the year of the protests.



3. Panel discussion
PanelOn 3 June, a panel discussion on the impact and legacy of the Tiananmen protests and massacre was hosted by Amnesty International UK. The panel included two generations of Chinese protestors, Wu Renhua and Shao Jiang, student protest organisers in 1989, Wang Ti-Anna, an activist born in 1989, plus Dr Jonathan Mirsky, a journalist who was in Beijing at the time of the protests.

Wu Renhua, Shao Jiang and Dr Mirsky all gave moving testimony to events in Tiananmen Square on 3 and 4 June 1989, including witnessing many Chinese protestors shot by Chinese troops and run over by tanks.

Wang Ti-Anna told the audience how she had been named after the Tiananmen incident and her ongoing campaign to free her father, Wang Bingzhang, who is serving a life sentence in China for his political activism.

4. Press Release
Soldiers and protestorsTo coincide with the 4 June anniversary, Chinese Uyghur Tibetan Solidarity UK issued a press release calling on the Chinese Communist Party to end its denial of the massacre and for justice for the victims. CUTS UK also called on the international community to insist the Chinese government upholds human rights, in particular the freedom of expression for all the peoples of China including Han, Uyghurs and Tibetans.

The press release quoted Shao Jiang, one of the student protest organisers in 1989 who now lives in the UK and is a member of Chinese Uyghur Tibetan Solidarity UK. "The wound of Tiananmen Square 1989 remains unhealed. We must seek the truth, expose the perpetrators of the massacre and bring justice for all those who lost their lives on 4 June 1989."

5. Flower-laying ceremony
On 4 June, survivors from Tiananmen Square, Chinese activists, Tibetans and representatives of human rights NGOs (including Tibet Society) laid 25 bouquets of flowers outside the Chinese Embassy in London to mark the 25th anniversary of the Tiananmen Square massacre.

As the first bouquet was laid near the door of the Embassy, jointly by activist Wang Ti-anna and Amnesty International UK Director Kate Allen, two Embassy officials emerged and pushed the two activists away from the Embassy, picked up the flowers and threw them away. The incident was captured by gathered media, including the BBC.



After the police shepherded the Embassy officials back inside, the ceremony continued. Tiananmen survivors Wu Renhua and Shao Jiang laid bouquets (pictured below right). Philippa Carrick (CEO) and Riki Hyde-Chambers (Chairman) laid bouquets on behalf of Tibet Society (pictured below left).

Ti-Anna was named for the protests and crackdown at Tiananmen Square. Shao Jiang was in the square on the 3rd and 4th June. Hear their stories.

6. Candlelit Vigil
VigilA candlelit vigil was held on the evening of 4 June, opposite the Chinese Embassy in London, to remember all the victims of the Tiananmen massacre.

Despite high winds and driving rain over 150 people attended the vigil. Special guests Wu Renhua and Wang Ti-anna and addressed the crowd along with Amnesty International UK's Director Kate Allen.

Following a minute's silence for all the victims of the massacre, the names were read out of all those who died and have been identified. Of over a thousand believed to have died only 202 bodies have so far been identified. The rest remain unknown or missing.

The evening concluded with the reading of a poignant poem written in 2011 by imprisoned activist Zhu Yufu.

“Is the Dalai Lama Bad for the West?”


I want to share with you four observations and questions on the topic ‘Is the Dalai Lama bad for the West’
Firstly, it seems that the Tibetan issue has been turned into the issue of the Dalai Lama. This has certainly been the position of the Chinese government. In the recent UN Universal Peridical Review On China, they blamed the Dalai Lama for organizing self-immolations inside Tibet. The Western governments only calls for the Chinese government to resume dialogue with the Dalai Lama. The newly elected Tibetan government in exile lacks recognition as well as self-identification. They haven’t really proposed their own political agenda that might expand the space which has been created but also restricted by the Dalai Lama’s Middle-Way Approach. 

Secon, Tibet is a bargaining chip for the west when dealing with China. It is generally assumed that countries that welcome the Dalai Lama’s visit will pay the price of losing China’s market. Because of this assumption top leaders in South Afria, Japan, Taiwan all declined to meet with the Dalai Lama in recent years. Cameron met with the Dalai Lama in 2012 and now promise not to meet with the Dalai Lama again. The implication is that by meeting with the DALAI LAMA, the UK had been punished in economy. But in fact, the bilateral trade in goods between the two countries reached $63.1 billion in 2012, surging 7.5 percent compared with 2011. China needs the world market more than the world needs China. China’s own financial and economic crisis is much more severe than that of the West.  
Thirdly, Dalai Lama, China’s colonization of Tibet is being strengthened by global capital chains. The West has joined in the plundering of resources in Tibet. There are many such examples: Siemens  via Asiaifom and China National Gold Group are jointly mining at Gyama, which provides key materials of military vehicles and equipments for factories in Sichan and Innermongolia. In addition, with technical assistance by Ford Motor Company, the military equipments  are used to facilitate crackdown on Tibetan uprisings.
Fourthly, I want to mention some of the new devices that CCP has developed in order to control Tibet. The  CCP Third Plenum developed at least two main survillence and crackdown in Tibet areas. Last week, the CCP Third Plenum announced the establishment of the National Security Council, which will incorperate domestic, foreign, military decisions to serve the stablity maintanence. This will allow the CCP to crack down more effecively and quickly on resistance in Tibetan areas. In addition, Chinese government has developed linguistic surveillance technology to monitor voice calls, messages sent online, as well as images embedded  within the communications line, in areas such as Xinjiang and Tibet where officials do not understand the local language. 
Finally, I want to put forward a question: apart from the West, the Dalai Lama, the Chinese government, are there any other actors in the Tibet issue? Especially the non-state actors, civil societies. What impact will they have on Tibet’s future?

我想就是否达赖喇嘛对西方不利的话题,分享四个方面的观察及其相关问题。
首先,这个题目本身看似将西藏(整个藏区,下同)问题已经转变成了达赖喇嘛的问题,这无疑是中国政府的立场。在最近的联合国普遍审议中国时,中国政府指责达赖喇嘛组织了在境内藏区的自焚。西方国家政府集中的要求仅陷于要求中国政府恢复与达赖喇嘛对话。新选出的西藏流亡政府对此问题也没有清晰的梳理,与前任政府相比没有根本区别,他们还没有提出自己新的政治议程,目前流亡政府没有扩大达赖喇嘛已创立中间道路的空间,只是受限于中间道路。

其次,西藏已经变成了与中国打交道时的筹码 (不仅是西方)。一般的假设是以高规格欢迎达赖喇嘛访问的国家将付出失去中国市场的代价。由于这个假设南非、日本和台湾最高领导人最近几年都拒绝与达赖喇嘛见面。2012年5月英国首相卡梅伦会见达赖喇嘛 ,马上承诺不再与达赖喇嘛见面了。中国的潜台词是与达赖喇嘛会面,将在经济上处罚英国。但事实上,这两个国家之间的双边货物贸易在2012年达63.1亿, 卡梅伦与达赖喇嘛见面后,较2011年同期大幅度增长7.5%(参见英中双方的官方数据)。中国需要世界市场远超过世界需要中国,中国自身的金融和经济危机远比西方严重。
再次,全球资本链强化了中国在西藏的殖民。西方已经加入了对西藏资源的掠夺。有很多这样的例子: 西门子通过Asiainfo和中国黄金集团西门子公司共同在藏区甲玛开采 ,甲玛的矿产不仅提供了手机材料而且为四川和内蒙古(南蒙古)军工厂提供了军用车辆及其军事设备的关键材料。此外,福特汽车公司生产线和技术支持,都用于强化镇压西藏的起义。
第四,上周的中共的十八届三中宣布设立国家安全委员会,将军事、安全、公安、司法、外交、金融高度集权,使中共更全面地控制藏区,可能更快速有效打击传统的抵抗。此外,中国政府继续在维吾尔区及藏区发展语言监控技术和图像识别信息, 便于中共军警的镇压。
最后的一个问题:除了西方、达赖喇嘛、中国政府,在西藏问题的其它角色的作用是什么?尤其是非国家行为者,各地的公民社会对西藏的未来有什么影响?

如何看八九六四遗产


海内外仍有不少人期许习李政权会最终平反六四。曾经是天安门广场学生参与者之一的邵江博士对此持否定态度。首先,他认为作为逆向淘汰体制下上位的中共领导人不可能这样做。其次,八九民运最伟大的传统恰恰是人民的自觉自主,而指望统治者平反则仍然拘泥于共产党的历史。不过,邵江认为,八九六四的遗产,既要肯定它的伟大和自主自觉的一面,也要看到它的局限性。今天,单单依靠街头运动不够,还需要 全面抗争, 建立独立的行会和底层自治,才能实现真正的制度和社会变革。
法广:如何看目前海内外呼吁习李平反六四的呼声?习李政权有没有可能这样做?
邵江:对习李会平反六四有很高的期望,不知道依据是什么。先来看看李克强的个人经历,他是从共青团这个系统一次次选拔上来的,经历了很多权力斗争。那么,什么样的人才能上来呢?只有那些遵从政权去镇压的人才有可能被选拔上来。 就是做到唯上。对上面负责,而不是对人民负责。习近平也一样。他在浙江镇压民主党,打击地下钱庄,打压民营经济,还有他从1979-82年直接在中共中央军委工作,其后和军方有一个紧密的关系网。在8964期间主张镇压的太子党和执行戒严和镇压的军委和戒严部队军官基本都是他现在的政治同盟,彭丽媛于1989年“六四”镇压后,在天安门广场为戒严部队演唱,可以反映他当时对“六四”镇压”的立场。 李克强直接对艾滋病输血扩散有责任。而且这个事件出来后,他一直捂着。对待毒奶粉事件他也一样。 在这种共产党体制下,什么样的人可以真正上位呢?就是那些执行领导意志,不管人民疾苦,藐视人民权利的人才可以上位。这是一种逆向淘汰,他们怎么可能平反六四呢?
另外,涉及到平反,许多民间人士也在用这个词。 持有这样观点的人大概是受限于中共的历史,比如说1979年的纠正冤假错案,对老干部平反。平反本身的意思是说在一定的历史阶段中,由统治者自上而下地或者给受害者恢复名誉,或者给受害者一个补偿,如此而已。这跟一九八九年人民自主反抗暴政的行动完全风马牛不相及。1989年凸显最重要的是人民自觉性,人民知道自己的权利,自己去实践这些权利。这是些什么权利呢, 蔑视限制公民权利的法规如北京市“游行示威十条”, 上街游行, 不惧怕官方威胁,自己组织集会,自己去办报, 实践自由结社,自己选举自己的独立的组织,独立的学生组织,独立的工人组织,独立的市民组织,反抗戒严,阻挡军队镇压,舍身救人,蔑视军管,保护活动人士免于迫害。八九年四月17号到六四之前,北京市成了一个和平自治的城市,没有犯罪方面的报道。这完全是人民的自觉,这是人民真正体现主体意识自下组织的运动, 1989年也是人民自觉反抗压迫的公民运动。难道公民自己评价自己的运动还不够吗? 现在统治者都是“六四”镇压的受益者,他们仍用“六四”镇压”的维稳模式维持统治,继续杀人和贪污。 依据国际人权法案, 有主体意识的公民需要一个没有任何正当性和合法性的政权去平反一个被他们镇压的公民争取权利和反抗压迫的运动吗?对待犯有反人类罪的政权,民间应该努力的方向是独立调查,追究责任,增强公民集体抗暴意识和能力。
法广:八九民运是自发的,自觉的民主运动,今天看来,这场运动有何不足,它的历史局限性在哪里?
邵江:虽然我们要肯定1989年民主运动的伟大性和自主自觉性,但我们也要看到它的不足,其中一个比较大的不足就是各阶层都准备不足。知识界尤其成问题。因为在纸媒时代,一个革命,一个人民自觉实践的过程必须要有知识人提供思想方面的东西,这个东西可以叫做思想武器,或者对未来的愿景等等。但当时的知识人实际上没有准备改变制度的思想和方法。他们许多人停留在伤痕文学的揭露阶段,大部分有政治意识的知识人所做的只是希望给官方当一个幕僚,把这个事件怎么给压下去。他们非常短视,胆小、自私和画地为牢,实际上学生也受到这方面的影响,我也受到这种负面影响。运动中没有真正体现出工人权利,理解工人的权利是什么?你可以说工人的主体性不够,但很少知识界和学生在80年代努力真正了解他们处境,努力研究他们在这个体制中是什么样的状况?当然也不会主动提出保护他们的权利和如何保护。另外,当时农民虽然通过承包制生活比毛时代有改善,但这是一个仍然不稳定的状态,他们实际上还是次等公民。知识分子和学生在运动中也没有陈列出农民的问题。还有另外一个问题,有很多机会都没有抓住。比如赵紫阳去天安门广场就是一个重大机会。赵紫阳去广场已经5月19号了,他去广场是去看望学生,只是想向学生解释一下:你们应该离开了,你们应该保重身体。他其实没有更多的想法。但周围的学生见了赵紫阳是一种什么样的心理呢?是一种嘉年会的心理,是完全没有自觉性的心理。其实,当时也有个机会,就是把赵紫阳扣下来,扣下来就是中国的另一次机会。但民间完全没有这个意识。
法广:这个设想很大胆,把党的总书记扣下来,那会不会出现更坏的情况,就是说,如果这样做了,那有没有可能变得更暴力?
邵江:我不认为会更暴力。如果从共产党党章看,赵紫阳是最高领导人,对他的要求更高,而仅仅是像对 38军军长徐勤先拒绝执行戒严命令的消极抗命的评价,是源于一个人的良知。邓小平是一个什么样的人, 看看他在毛泽东和华国锋当政时的表现就明白了,他是一个只认对方实力的人。赵紫阳在广场的时候,他的象征意义很明显,他就是作为共产党法定的最高领导人,不是说党指挥枪吗?他说不想开枪,那可以跟广场上的人一起来做吗。那样的话完全可能出现比叶利钦819还正面的结局,不一定一定是暴力,一定是内战。我觉得恰恰是那些短视的人在这样解释历史。而且赵紫阳自己也没想到要挑战邓小平,这也是他个人的局限,对一个像赵紫阳处于这样高位置的政治人物,对他不仅是评价他的良知,同时要评价是否他有政治远见和他是否知道如何实现政治远见。在中共这种体制下,政治远见对赵可能要求太高了,1989年的赵紫阳是一种可遇而不可求的事。当他出现了,那民间的自觉性够不够, 就是一个测试。你看周围大学生见到赵紫阳就要签名,就像见到一个名人那样的嘉年会的心理,你就明白,实际上他们没有这个自觉性。 5月19日赵紫阳去广场可以看成1989年运动的一个历史分水岭,运动的参与者和赵都丧失一次将水流引向另一个方向的机会。当然民间自觉自主必须从平时就培养,要求平反本身就是承认这个政权是有合法性的。实际上共产党在1989年就没有合法性的。他拿到政权40年,是一个没有经过人民授权的一个政权。没有经过一次公正的选举,而是不断地制造公共灾难,不断的地通过运动整一批一批的人的一个政权。民间当时也没有联合的意识,学生和知识界也没有与所有被压迫的人民互动。因此,八九年运动在这几个方面不足也是它被镇压后,不能立即大规模继续抗争的原因。这就是我对整个1989年运动的评价,现在中国社会也面临这些问题。
法广:对你来说,如果要给六四还以公正,那就只有进行革命了?还有没有其他的途径?
邵江:我觉得只有革命。在现在这个阶段上,没有别的方式,但是这个革命,我们必须得找出革命的意识, 革命的手段。革命也不仅仅陷于暴力和非暴力的问题,这里只讨论如何能带来一些重要的变化。六四之后,共产党的执政没有一秒钟的正当性和合法性,他们只是在进行加速的抢劫,对人民的抢劫,对弱势群体的抢劫。其实我并不喜欢弱势群体这个词,人民被共产党标识成了一个弱势群体,你自己认为自己弱势吗,是因为你自己的意识不够?是你没有给自己授权、你自己给自己赋予的力量不够?如果是这样,一定需要学习再学习增强能力,你需要了解在这个制度下,其他被压迫群体的状况,学习如何平等对待其他被压迫群体和承认他们的权利,培养联合行动和组织能力。现在恰恰是培养这种能力的时候了,要完成变革,只能靠人民自己。从18世纪到现在世界上任何符合正义原则和向保护所有人权利的根本变化,都来自公民广泛自觉的实践,重要的是包括自治和行会独立。
法广:你不断地强调自主和自觉性,你看到今天中国的民间有这种希望、有这种苗头吗?
邵江:其实是两个方面都有,既感到有一部分有这种迹象,他们有更强的自觉性。但另一方面,也能看到,他们的主体性还不够。但是,中国大陆是非常难由一个全景观察的,许多看到的现象都是局部的,在这种情况下你就很难把它全部拼出来,回答是不是整个民间就有这样的主体性。但是我们能看到,民间对政权已经越来越没有奢望了,没有期盼了。更多的人是想要自己去解决问题。而想通过上访,经过什么法律途径解决问题,最后都是完全绝望的状态。因为这个制度不太可能根本解决问题,即使有时一些个案当事人的情况有所改善,以个案解决为目标,没有长远目标的个人或团体不会对网格化维稳有根本摧毁,究其是面对一个腐败透顶和专制透顶的政权。大家现在可能觉得,希望这个政权改革,你加压力这种方式已经是越来越渺茫了。所以能看出有些人是 在积极地做一些平行政治的东西。但还看不出整体的。但香港有一个苗头。从去年反国教运动可以看出年轻人的主体意识正在加强起来,他们比老一代包括港支联对中华民族和爱国这样的意识形态更有批评意识,对‘大一统’更有警觉。
法广:在香港邻近的城市,比如广州深圳,有好多九零后的年轻人,投身到街头的民主运动,他们很勇敢,他们有些甚至喊出了要终结专制的口号。有些被警方抓走了,有些又被放了,他们照做不误。你注意到南方的这种现象没有,好像那里的空气比较宽松一点。
邵江:我看到了南方这些城市发生的现象。因为它们远离北京,相对而言,广州本身资讯比较发达,又邻近香港。但当局这种处理街头运动的方式实际上是隔断你,实际上是要你不要去跟社会上其它的各阶层去联络。而这恰恰是共产党的死穴和他的短处。八九年的街头运动给我们一个启示,就是街头运动是改变中国的一个办法,它是改变体制、争取自己的人权和自由的一个办法,但是不能单单靠街头运动,工人要组织起来。要有独立的工会,要有独立的农会,要有农民工自己的组织。然后这些阶层有一些共识,这些共识是什么,就是世界人权宣言,就是九个人权公约, 就是说我们尊重和保护所有受压迫人民的权利。包括西藏人民的权利,包括他们的自决权,承认和支持他的自决权,而不是假设自己能代表对方的多数,功利将对方纳入自己的一个框架。一个真正应该重视的改变 是争取民主、争取所有人的人权从而保障所有人的自由的有广泛参与,包括不同族裔、性别、不同社会阶层的公民集体行动,争取所有人的权利和所有公民权利。
法广:但现在这种条件还似乎没有成熟?
邵江:现在能看出一些苗头。从微博上看,越来越多的人讲到了普世价值,讲到对受压迫者的同情。倒退十年之前,很多人都可能不知道西藏发生了什么,新疆维族地区发生了什么。这些都是禁区,现在有些人就开始逐渐冲这些禁区。我觉得这是一个很好的现象。就是说,你对1989年的遗产,你要肯定一些非常重要的正面的东西,你也要看到它的局限性。这个 才能使我们完成一个改变或革命,既是真正的制度性变革,也是个人和社会的改变,才能走向真正的民主,保障所有人的人权,保障所有人的平等,保证在一个正义制度下每一个都有真正的尊严。

另外的抗争方式

1、利用《中华人民共和国政府信息公开条例》,要求中国当局公开对藏政策

根椐《中华人民共和国政府信息公开条例》,我们有权要求中国政府公开信息,并必须在15天内答复。这里有一个非常好的杠秆就是,明年是联合国人权组织对中国审议的重要年份。这是对中国的第二轮审议,这一轮审议,境内藏人可以直接要求参与中国政府的整个书写国家报告过程,因为中国政府写报告就是闭门写,他说的NGO 都是官方的,像妇联、全国总公会等,根本不可能代表西藏境内的公民,中国人已开始做这个活动了,经常去外交部要求,作为民间个人或民间的某一群人,要求政府信息公开,比如,公开劳教制度,它是怎么制定的,是否违反了公约等。像藏人,就可以要求让尊者回来,这是基本诉求,可以向外交部、国务院发函要求,如果十五天之内,外交部和国务院不答复,就到北京上访,藏人的勇气是没有问题的,这批抓了,下批还可以接着去北京上访,把这件事情一直坚持到明年五月份,经济文化国际公约的审议。

二月份还有一个国际人权公约的审议,也是对中国的。这个审议的过程是互动的,是国际互动, 让国际利用人权扛杆改善整个中国共产党统治下所有人的人权状况。这对藏人是个很重要的机会,把自己的要求向国际社会发出来,同时要求中国政府把所有的对藏政策公开,完全信息公开化,比如你在藏区建立了什么工厂,如何让藏人失去了自己的土地等等, 都可以要求信息公开。因为中国政府签了9个核心人权公约中的7个, 人大还没有批准几乎所有公约的任择议定书(推动批准所有公约和任择议定书,需要民间继续努力),但是,作为联合国的成员国, 就必须遵守所有9个人权公约,还有一个就是世界人权宣言,每一条都必须严格遵守。

调动所有境内藏人参与,给政府施加压力,要求共产党改变。还有一个就是,中国共产党这63年的统治,一直是没有合法性的。因为,在联合国的政治公民权力和政治公约里,非常明确地规定,政府的构成必须经过定期自由公正的选举,而中共从来也没有这个过程。就此,对它在藏区的统治,也可以追问,究竟是合法的还是侵略的。另外,《公民权利和政治权利国际公约》和《经济、社会及文化权利国际公约》第一条款就列明了,所有人民都有自决权,作为一个民族当然有民族自决权。

中国政府在宪法中声称人民有当家做主的权力,同时又声称共产党有领导地位,这本身就矛盾,是一个伪宪法,不附合国际人权公约,应该直接质疑宪法非正当性和违反国际人权公约。目前,中国的民间团体也在推进公民行动,如果藏人投入类似的行动,可以让汉人了解藏人的遭遇、处境,可能帮助民间被压迫团体联合起来,反抗压迫者和殖民者,共同改变被奴役的现状。

2、以平行选举的方式,削弱、坍塌中共的统治

对于中国政府,我们在研究整个制度转型时,政治学上定义为极权统治,意思是这个政权控制一切,因此,不要对其有任何自动改良的幻想。

我说的选举是平行选举,利用现在的选举机会,投两票下去,一票走官方的票箱,另一票是我们民间自己组成的选举委员会的票箱,比如整个西藏 (所有藏区),全部选出自己的各级议会,,当局肯定要捣毁的,但是,既然选出来了,就有其合法性,既使当局捣毁的话,还有后续的,等于平行地进行了另一套政治。获取合法性和正当性,同时可以经济上自助,比如自己搞地下银行等,进行全面抗争。

通过选举方式的真正自治或自决, 各方面可以集结抗争和产生共振,导致现政权控制力下降。实际上,波兰在80年代已经在做了,团结工会和其它独立行会在地下活动了十年以上,达到总人口的五分之一。如果西藏大多数人实践有效自治或自决,中共扶持的那一批人,一定被多数藏人抛弃,中共在藏区的统治基础就坍塌了。

不要总是幻想等待中共当局搞民主或期待他们与流亡藏人行政中央谈判(从1979年的谈判基本都是中共主导的解除自我困境的成功外宣,境内藏人的处境在多数情况下不仅没有改善,而且更恶化。谈判只是政治斗争的一种方式,在双方势均力敌时,可能达成妥协,这种妥协可能与正义无关;在双方力量悬殊时,被压迫一方切记不要希望与压迫集团谈判而被它们利用,丧失自主的政治行为),你要想,我现在就自由了,我要执行我的权利,我要运用我的权利,不要等待西藏获得自由后,我再选举。这是非常重要的公民抵抗形式,但是,一般来说,像乌坎村民选举和其它汉字地区的选举,问题是太分散和缺乏有规模持续的坚持,但藏区没有这个方面的问题,你们有语言的同一性,信仰的同一性,以及境外的民主经验等等,比乌坎更有条件,当然不利之处在于中共对藏区的防范更严密和镇压更严厉,但如果发展现代有创造力的公民抵抗,迫使殖民政权只能是疲于奔命式的防范,最终结局一定是殖民政权垮台。

3、具体运作

比如在同仁县,就可以搞选举,开始是选举人大代表, 实际上藏人在选自己的平行同仁县议会 ,就把你们选出来的候选人,介绍大家,从县到乡到村落等,但是官方肯定要打压的,不过,没有关系,你们继续做,万一抓起来,还有新的候选人,到截止日期就开始投票,一张票投县人大代表,另一张票投议会代表,因为共产党的投票信箱里面,你是从来看不到的,不可能监督。这方面《公民权力和政治权力公约》有明确规定,选举必须是透明的。什么是透明呢?就是正式点票过程是透明的,有独立人士和反对人士监督全过程,不能在里面做票,另外,必须是秘密投票,你不能威胁,说必须选这个候选人。但是威胁、压制和操控选举在中共统治下是常态,因此藏人必须坚持自己的平行选举,获得真正意义的自治或自决。

竟选过程中,独立候选人会得到选民的支持,在和选民见面时,平时不能说的话,在选举时就可以说,并且,一起组织一个支持候选人的后援团,实际上在实践结社自由,中国大陆长期以来是没有的,通过这样的选举,就把结社的自由,言论的自由,集会的自由一起实践,在这个时间段充分地实践公民权利和集结公民力量 。

4、内外共振:利用国际法,起诉2008年镇压藏人的中共官员

境外藏人和支援西藏组织起诉反人类罪的官员,比如,起诉中共官员在2008年镇压和平示威的藏人。中共官员的镇压导致上千人失踪或死亡,这就是反人类罪。起诉成不成功是一回事,但重要的是,这是国际法,其含义就有强制性,能不能执行是一回事,但将来一定会有意义。就像红色高棉屠杀柬埔寨人民一样,这就是国际法,中国政府签不签罗马公约也没有关系的,反人类罪的追诉时期不受时间限制 ,起诉中共官员可以成为一个重要的国际压力。

法轮功的起诉就是有效果的,他们直接起诉了江泽民,所以江泽民退休后是不敢去西班牙的,而且连欧洲也不敢去。这个很简单,就算当地政府有外交赦免,不能直接传讯的话,也是一个丑闻。这是反人类罪普遍适用的原则,中共被起诉的官员,都没有胆量访问欧洲,这个有先例 ,像以色例的总理,前年去伦敦访问,因为巴勒斯坦已在起诉他的战争罪了,英国政府很丢脸,只好让他赶紧走,因为再呆下去,第二天就出传票了。传票是由法庭直接下达给批准《国际刑事法院罗马规约》国家的警察,而不必知会这些国家的政府,警察应在管辖的区域或公海逮捕反人类罪的嫌疑人。如果西藏的团体能够得到国际组织的帮助,运用国际法,使起诉成功的话,那是非常重要的国际扛杆,因为对中国这种大国,国际的压力是必须的。

5、迫使中国当局执法

中国的法律,在毛时代就是人治,而邓时代的法律包括胡温时代,都是依法治国。什么是依法治国呢?就是说,法律是个工具,对我有利我就用,对我没有利就扔到一边。因此,可以出台很多法律条文,有些条文甚至达到了国际水准,但是,当局是不执行的。因为,最高的宪法,就是四项基本原则,已经保证了中共的领导地位, 所以其它法律都是从属的。

民族自治法在上个世纪五十年代就起草了,条文也出来了,但没有实施,因为已经有了宪法保证中共的领导地位,即使制定民族自治法也不会有民族自治。民族自治法在当时是中共政权的初级阶段,要在字面上给你一些权利。中国政府对外回应就是念法律条文,宪法有两方面的作用:一方面是外宣的需要,另一方面是在宪法的框架下,保护自己的特权。

但是,我们现在,要从民间开始,使用保护权利的法律,要求当局兑现,当局不兑现,可以使认识到这个困境,寻求其它途径保护自己的权利。

6,习近平上台后,西藏问题是否会出现转机?

不会,甚至更恶化。原因也比较简单:

第一,他爬到那个位置上,肯定手上沾满了鲜血,这个政权就是逆向逃汰,完全没有人性;

第二,他是党内利益集团的一个平衡。

原来大家觉得胡锦涛上台会有点作为,有人甚至把胡温时期,定为胡温新政,实际上,但比江泽民时代更坏。原因是共产党内部已经制定了一个关于西藏的基本框架,一般来说,任何人上台,都不会动这个框架,因为,有一个庞大的利益集团,不断地从西藏这个框架中捞到好处。

第三,原来胡的上头号只有一个太上皇,现在,习的头上有两个太上皇,所以,更不会改变。

第四,习的父母虽然在文革期间受过迫害,但是,他这批人都是太子党红卫兵,崇尚暴力,他们的教育,完全是共产党的教育,他们自己不会改变。

唯一的变化,只能是藏人自己的努力,以及中国民间开始广泛尊重藏人的权利,与藏人一起共同奋斗,既争取自己的权利,又帮助藏人争取权利。

On Tuesday the 4th of June, 7pm-9pm, around 120 protesters gathered outside the Chinese Embassy in London to commemorate victims of the Tiananmen (Beijing) Massacre in 1989. Protesters read out the names of known victims of the massacre. This year, the vigil saw more young people joining the June Fourth commemoration. Although the Chinese regime has continued to suppress the truth about what happened 24 years ago, more and more young people have started to look for the truth.

On Tuesday the 4th of June, 7pm-9pm, protestors will gather outside the Chinese Embassy in London to hold a candlelight vigil commemorating victims of the Tiananmen Massacre in 1989. Protestors will read out the names of known victims of the massacre, and mark their names on a street map of Beijing showing the places where most of these victims were killed or the hospitals to which their bodies were taken.

Several Tiananmen prisoners including Miao Deshun (苗德顺), Chen Yong (陈勇), Luan Jikui (栾吉奎), Deng Wenbin(邓文斌), Sun Guanghu(孙广虎) and Yu Rong(余蓉) are still believed to be incarcerated. Thousands of Chinese were detained after the pro-democracy movement. Some of them, after going to prison more than two decades ago, returned to activism after they were released and have been subsequently jailed, repeatedly in some cases, and are in prison today. Chinese courts have reserved some of the harshest sentences on political charges to pro-democracy advocates from the 1989 era, including Nobel laureate laureate Liu Xiaobo (刘晓波), Chen Wei (陈卫), Chen Xi (陈西), Liu Xianbin (刘贤斌), Yang Tianshui (杨天水), Xu Wanping (许万平), Zhu Yufu (朱虞夫), Xie Changfa (谢长发), Shi Tao (师涛), and Li Bifeng (李必丰). Li Wangyang (李旺阳), a worker activist in the 1989 pro-Democracy Movement, released after 22 years imprisonment, died in highly suspicious circumstances on 6 June 2012.

The Chinese regime has continued to suppress the truth about what happened 24 years ago. Activists nationwide are facing heightened restrictions on movement as police have been mobilized to prevent public memorializing of the victims and calls for accountability of the massacre.

On the 24th anniversary of the Tiananmen Massacre, we repeat our demands: investigation into the truth of the massacre, prosecution of those responsible, an end to the authoritarian rule of the Chinese Communist Party, guarantee of human rights, and democratization of China!

Human Rights Day 2012 Speech

Today marks the 64th anniversary of the Universal Declaration of Human Rights. This landmark charter recognised that ‘everyone has the right to take part in the government of his country, directly or through freely chosen representatives’ and that ‘the will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections’. These values, endorsed by the international community, are legally binding obligations upon the 167 States Parties including the People’s Republic of China. However, the Chinese regime continues to flagrantly show utter disregard for basic human and civil rights and openly flout the Universal Declaration of Human Rights and UN Human Right Treaties that PR China has signed.

In today’s China, the reality is ‘absurd’. In November alone, lacking any popular mandate, Xi Jinping and Li Keqiang assumed the Party’s top two positions of power with the new seven-member Standing Committee of the CCP Politburo revealed at the 18th Party Congress after power struggles behind the scenes. This power transition took place when Sichuan dissident and poet Li Bifeng was given a 12-year sentence on a fabricated charge of ‘contract fraud’, and when, within a month, another 28 Tibetans set themselves on fire.

I condemn the Chinese regime for repressing cultural and political rights enshrined in the Universal Declaration of Human Rights and UN human rights treaties. People have the fundamental right to rise up and overthrow any government which has no legitimacy to represent the people under its rule and deny fundamental rights. We call upon civil society across the globe to stand in solidarity with repressed people under the illegitimate rule of the Chinese Communist Party.

  • release all prisoners of conscience held by the Chinese regime,
  • urges the Chinese regime to allow independent observers and the international media full and unhindered access to all parts of the People’s Republic of China, in particular Tibetan and Uyghur regions,
  • calls on the European Union to refer the human rights situation in China to the European Court of Human Rights,
  • calls on governments and leaders around the world to make human rights a top priority when engaging with the Chinese leadership, and publicly state their solidarity with human rights defenders and the Chinese, Uyghur and Tibetan peoples,
  • urges the international community to demand democracy in China, as the Chinese Communist Party does not represent the people living under its rule.
  • calls on civil society across the global to show solidarity with repressed people under the rule of the CCP.

Urgent Appeal for Credible Investigation into the Truth of Li Wangyang(李旺阳)’s Death

Hunan labor movement leader Mr.Li Wangyang (李旺阳, see below for bio) was found dead in the morning of June 6th, 2012, in Daxiang Hospital, Shaoyang municipality, Hunan province (湖南邵阳市), China. Mr. Li’s brother-in-law Zhao Baozhu (赵宝珠) told media that he received a call from the hospital, around 6am on the 6th, announcing Li Wangyang’s death. At 6:50am, Zhao found Li Wangyang in his hospital room hanging on the window frame. Media quotes Li Zanmin (李赞民), friend of Li Wangyang, as saying that Li’s body was erect in front of the window with a ribbon around his neck. Around 9am, friends and relatives of the dead received words from the police that Li Wangyang “committed suicide by hanging himself.”

From all the media information available thus far, there are a lot of questions about the “suicide” claim the police has made:

1. Mr. Li Wangyang doesn’t seem to have a motivation to commit suicide. Relatives and friends have all confirmed that Mr. Li is optimistic and resilient, his health has been steadily improving, friends have been raising money for his medical needs, and they are not aware of any suicidal tendency on Mr. Li’s part. His close friend Zhu Chengzhi (朱承志), who had a long conversation with Mr. Li on June 4th, told media that “Wangyang is a tough man. Even with unbearable pains, he would never choose suicide to end his life.” Mr. Li’s brother-in-law Zhao Baozhu said that, in the evening before, Li told his sister to bring a radio to him so that he could listen and stimulate the faint hearing of his left ear. When interviewed just days before the 23rd anniversary of June 4th Tian’anmen Square Massacre by iCable, Hong Kong, Mr. Li Wangyang encouraged Ding Zilin (丁子霖), leader of the group called Tian’anmen Mothers, that she has to continue to persevere. He said in the same interview that he had never regretted what he had done 23 years ago. “Each ordinary man has a responsibility for democracy, for the wellbeing of the nation. For China to enter a democratic society sooner, for China to realize a multi-party political system sooner, I will not look back even if I have to risk my head.”

2. On-the-scene evidence is insufficient to support the “suicide” claim. A picture of the scene shows that one end of a white bandage strip looped somewhat loosely around Li Wangyang’s neck while the other end apparently tied on the window frame. The bandage loop is loose, and Mr. Li’s face shows no signs of distortion. His feet touch the floor with his slippers still on. All in all, he shows no traces of struggle often seen in death by hanging. Furthermore, from the video of the iCable interview, we can see that Mr. Li, blind and deaf, needed help to just walk, and it is also a question where and how he obtained the bandage strip with which he “hanged” himself.

3. The police prevented relatives and friends from taking pictures of the body and took the body away. Zhao Baozhu and Zhu Chengzhi confirmed to the media that relatives and friends of the dead asked the police to allow them to take detailed pictures, but the police rejected their request and took the body away around 10am, even though several dozens of friends attempted to block the police. Local police also thwarted rights defenders from visit Mr. Li’s home to send their condolences and to learn more about his death. Police’s actions, all in all, raise the question whether the authorities have something to hide. Mr. Li Wangyang has been watched 24 hours a day by several security police since prior to June 4th and they were still at the scene when the event occurred. It is puzzling then why Mr. Li could possibly have committed suicide.

As citizens who are deeply concerned with the state of human rights and the democratic development in China, we hereby solemnly make the following appeals:

1. Designate an authorized forensic science institution outside Shaoyang municipality to look into, and identify, the true cause of Mr. Li Wangyang’s death, accompanied throughout by representatives of family and friends. The findings shall be presented to the public;

2. For humanitarian reasons, allow Mr. Li Wangyang’s friends to visit his home, send their condolences, and help with the funeral and other affairs;

3. Hold local police accountable for their criminal and civil responsibilities for Mr. Li’s death, and pay necessary reparations;

4. UN’s relevant treaty offices, world governments and international organizations shall monitor the case, and pressure the Chinese government, to ensure that Mr. Li’s death will be dealt with fairly, judiciously and transparently.

Li Wangyang’s Biography:

Li Wangyang, male, was born in 1950 and resided in Shaoyang, Hunan province, China. Influenced by the famed “Democracy Wall” in Beijing and, later, by the Solidarity movement in Poland, Li Wangyang organized “Shaoyang Workers Cooperative” in 1983. He was arrested because of it but was spared of criminal charges. During the June 4th movement in 1989, Li and others established “Shaoyang Workers’ Autonomy League”, with Li as the Chairman, that mobilized workers to demonstrate and protest in support of the democracy movement raging on in Beijing. He was arrested on June 9th the same year and later sentenced to 13 years in prison for “anti-revolutionary advocacy” and “inciting to subvert state power.” In prison, Li Wangyang was beaten and tortured for being “unyielding”. When he staged hunger strikes to protest against torture, guards forced him to eat by prying open his mouth and, in the process, broke several of his teeth. Over his lengthy imprisonment, he suffered from debilitating illnesses that resulted in him losing both sight and hearing. In June 8, 2000, he was freed with reduced prison time. To defend his legitimate rights as a citizen, Li Wangyang soon sought reparations from the government for persecution that resulted in him completely losing the ability to work. In May 30, 2001, he was again thrown in prison with a 10-year sentence, this time baselessly charged with “assaulting state organs”. He was freed on May 29, 2011. The 2011 Country Reports on Human Rights Practices, released recently in May 2012 by the US State Department , listed Li Wangyang as one of 128 Chinese dissidents and rights defenders to be concerned with. In its commemoration of June 4th just days ago, the Independent Federation of Chinese Students and Scholars (IFCSS) awarded Li Wangyang the 2012 “Spirit of Freedom Award”.

关于要求严肃调查李旺阳死亡真相的紧急呼吁


中国湖南工人运动领袖李旺阳先生,不幸于2012年6月6日清晨被发现在邵阳市大祥医院内身亡。媒体引述李旺阳的妹夫赵宝珠的说法称,赵于6日早上6时左 右收到医院的电话说李旺阳已经死亡。6点50分,赵在医院房间,看到李旺阳整个人吊在医院的窗框上。媒体引述李旺阳的朋友李赞民称,当时李旺阳的身体竖立在窗前,脖子上有一根丝带。6日上午9时左右,李旺阳的亲友转述警方的说法称李旺阳是“上吊自杀”。

综合媒体报道,警方称李旺阳系“自杀”的说法存在诸多疑点:

一、李旺阳不存在自杀的主观动机及迹象。李旺阳亲人及朋友均证实,在他生前也没有了解到他有任何自杀的想法,李旺阳为人非常乐观坚强,身体情况也一直有好转,朋友们也正在为其治病筹款。6月4日刚和李旺阳长谈的友人朱承志对媒体说:“旺阳是一个铁骨铮铮的人,就是说哪怕有极大的痛苦,他无法忍受,也不选择这种结束生命的道路。”李旺阳妹夫赵宝珠称李旺阳在6月5日晚上还跟他妹妹说,想买一个收音机,刺激一下自己左耳微弱的听觉。李旺阳并于六四前夕接受香港有线电视(iCable)采访时勉励天安门母亲丁子霖要坚持,并表示自己从不后悔:“为民主,国家兴亡匹夫有责,为了国家早日进入民主社会,为了中国早日 实现多党制,我就是砍头,我也不回头。”。

二、现场证据不足以支持李旺阳“自杀”的说法。从现场传出的照片显示,绷带一头从侧边系在李旺阳的脖子上,另一头系在病房窗户窗框上,未见绷带紧勒李旺阳脖子,李旺阳五官未见异常。李旺阳双脚脚掌接触地面,拖鞋仍穿在脚上,并无上吊死亡时常见的挣扎迹象。香港有线电视记者此前访问李旺阳的片段所见,李需要旁人搀扶,才可步行,加上李旺阳双目失明,两耳失聪,“上吊”用的绷带从何而来亦成疑问。

三、警方拒绝亲友拍照遗体并抢走遗体。据媒体报道,赵宝珠和朱承志证实,案发后死者亲属和朋友向邵阳警方要求做全面拍照,但被警方拒绝,警察还在早上十点左右运走尸体,几十个朋友拦截无果。湖南当地警方还阻挠多名维权人士前往李旺阳家致哀及了解情况,种种行为无不令人怀疑警方是否企图有所掩饰。自六四前夕始,就由当地多名国保人员日夜看守李旺阳,在事发时仍未撤走,李旺阳为何还会意外身亡亦让人不解。

作为关注中国人权和民主进程的公民,我们在此郑重呼吁:

一、由邵阳市之外的法定机构,在李旺阳亲友代表的全程监督之下,严肃调查李旺阳的真正死因并公诸于众;

二、出于人道主义,允许李旺阳的生前亲友自由前往李旺阳家中表示哀悼及协助处理后事;

三、追究当地警方在事件过程当中的刑事或民事责任并作出必要的赔偿;

四、联合国相关条约机构、各国政府、国际组织加强对此案的监督并适时施加压力,保障事件能得到公平、公正及透明的处理。
李旺阳,男,1950年出生。湖南邵阳市人。高中毕业后到邵阳玻璃厂当工人。受北京西单“民主墙”及波兰团结工会影响,李旺阳1983年与朋友组织“邵阳 市工人互助会”,当年被抓,后免于刑事处分。1989年“六四”运动时,参与组建“邵阳市工自联”并担任主席,发动工人游行、示威,声援以北京为中心的民 主运动,同年6月9日被捕,以“反革命宣传、煽动罪”判刑十三年。入狱之后,李旺阳因“态度顽固”而被毒打和施加酷刑,李旺阳后来因为绝食抗议酷刑,反被狱卒强行撬掉多颗牙齿强迫进食。此后长期疾病缠身,最终导致双眼失明,双耳失聪,生活完全不能自理。2000年6月8日获减刑后释放。李旺阳出狱未到一年,即因在监狱遭到非法迫害致使完全丧失劳动能力之事向政府索赔,以维护公民合法权利。在2001年5月30日再度以莫须有的“冲击国家机关”的罪名入 狱,刑期为十年。于2011年5月29日刑满获释。2012年5月,美国《2011年国别人权报告》把李旺阳列为128名中国大陆应被关注的民主维权人士。“全美中国学生学者自治联合会”理事会在2012年的“六四”纪念活动中宣布,将2012年“自由精神奖”授予李旺阳。

伦敦书展欲为北京「大外宣」搭台?


今年的伦敦书展将在416日至18日举行。中国是这次书展作为“市场焦点”的主宾国。代表团的高级官员包括制造文字狱的主管、体现党国一体的中共中央政治局常委李长春,体现权力世袭特色的国务委员刘延东,执行文字狱、体现党国传播和镇压一体的新闻出版总署署长柳斌杰。他们将率领180个官方出版商、21名钦点作家、众多的官媒记者和锦衣卫,来到伦敦,“组织300多场活动”,掀起强劲的中国风’”,同时开通官方网站和微博。

中共利用书展提升软实力不是第一次,2009年法兰克福书展也曾派出这种高级别的代表团。法兰克福书展主办方全面接受中共旨意,同时为了应对舆论压力,也邀请了两名异议作家­­——来自大陆的戴晴和流亡海外的贝岭,书展期间,他们两位成为有批评意识的媒体关注的焦点。戴晴和贝岭受邀参加开幕式,中共代表团不满而退场,甚至取消了剪彩仪式,中共驻德大使在会议厅训斥主办方半小时,延缓了大会议程。

本届伦敦书展的主办方从一开始就避免邀请中国大陆的异议作家。在英文媒体发表了贝岭批评书展没有异议声音的文章后,英国文化协会回复贝岭,说明邀请了两名居住在英国的中文作家参加书展的文化活动。英国文化协会对媒体和部分公众质疑为何不邀请刘晓波和其他狱中作家、为何不设立这些作家作品展位,不予理睬,只是说明书展仅仅是文化贸易。但是伦敦书展是何种文化贸易?

伦敦书展的主办商励展博览集团(Reed Exhibitions)早已进入中国发展,以励展博览集团大中华区的名衔主办广泛的会展活动,包括航天与航空、博彩与地产等行业的展览会。英国文化协会(British Council)五年前成为伦敦书展“市场焦点”项目的战略伙伴,理所当然成为本届书展文化项目的合作方。双方的合作,应和了中国所谓的“文化搭台,经济唱戏”。主办方号称要把今年的“市场焦点”办成该项目自2004年启动以来最大的一次。

这次书展将是自从2010年刘晓波获得诺贝尔和平奖后,中共第一次以这种高级别参加对外文化活动。有英国文化界的朋友说,他们受到来自中国驻英使馆、中方记者和学者的极大压力,反复企图迫使他们参加书展开幕式。开幕式将在416日举行。这是一个有象征意义的日子。23年前的同一天,天安门广场纪念碑周围开始出现自发聚集的人群,悼念胡耀邦。次日起,北京高校学生开始游行至天安门广场,静坐并提出游行请愿七条 ,包括要求民主新聞自由言論自由允许民间办报。当时正在美国哥伦比亚大学访问研究的文学博士刘晓波随即响应,参与海外中国留学生和访问学者的声援活动,并于426日中断研究计划,回到中国参加民主运动。

而今因言获罪正在服长期徒刑的刘贤斌、杨天水、朱虞夫、谭作人、陈卫、陈西、许万平、师涛等都是1989民主运动的全程参与者。朱虞夫去年因上网发表《是时候了》,获刑7年。这首同名诗最早出现在1957年,作者沈泽宜张元勋联合其他学生以大字报为媒介推动了五一九民主运动。其后大字报和油印刊物又进一步助推了民间运动网络的形成。由于中共对民间传媒网络的镇压,数万涉入者被投入劳改营长达二十余年,上千人死于非命。不过这种民间传媒和民权运动的结合真正挑战了党国集权体制。民权运动经常始于个体的公民借助传媒形成多维度的网络以抵抗强权。中共可以镇压一场运动,但不可能根除民间传媒。数码时代的自媒体与民间纸媒形成互补,与民权运动结合,形成公民抵抗的网络。阿拉伯之春证实了这种网络瓦解强权的力量。虚拟空间和物理空间的结合,民间传媒和民权运动的结合,国际民间组织的联合,必将创造公民抵抗的多元共振模式,挑战专制制度和国际资本对民主制度的侵蚀,在全球范围内结束专制、巩固民主,并为以国家为共同体的民主制度的局限寻找出路。
